Proposed Change

Under current law, consensual sexual activity involving minors is generally not reportable, although the law acknowledges the need for mandated reporting when certain age differences between the participants have been exceeded, even in cases of consensual sex.  Please refer to the aforementioned CAMFT articles for information about differing age criteria.

We believe that the law regarding age criteria should be applied equally to all forms of sexual activity.  Our proposed change is quite simple: regarding consensual sexual activity involving minors, oral or anal sex should not be reportable as child abuse—the same as intercourse is not reportable.
